Ruling declares that ridehailing company drivers decide whether, when and for how long they work, not when their employer says
The ridehailing company Uber does not have a traditional employment relationship with its drivers, the Fair Work Ombudsman has ruled, because drivers have control over “whether, when, and for how long they perform work”.
The decision comes after an investigation into how the two parties interact as a workplace, and claims from a lobby group, Ride Share Drivers United, that drivers are effectively employees and should be treated as such.
